Coast Guardsman sentenced to 18 months confinement for sexual assault

December 12, 2014

CLEARWATER, Fla. — A Clearwater-based Coast Guardsman was sentenced by a military judge to 18 months confinement, a dishonorable discharge, and a reduction in pay grade to E-1 after being found guilty of aggravated sexual assault at a general court-martial held Friday.

Coast Guard Seaman Colby C. Bailey, 23, was found guilty of violating Uniform Code of Military Justice Article 120 (Aggravated Sexual Assault) and Article 128 (Assault Consummated by a Battery) Thursday after more than three hours of panel deliberations.

Under the Uniform Code of Military Justice, sentencing occurs immediately after a guilty verdict.

Bailey was assigned to Coast Guard Air Station Clearwater at the time the offense occurred.

Rear Adm. John H. Korn, commander of the Seventh Coast Guard District, which is headquartered in Miami, was the convening authority for the court-martial.

The Uniform Code of Military Justice is a complete set of criminal laws that covers most crimes contained in civilian law in addition to other military-specific offenses such as failure to obey an order, desertion, etc.  Additional information about the UCMJ and the military justice system can be found at:  http://www.uscg.mil/legal/mj/MJ_Doc/UCMJ12.pdf
